In this case our office was successful in recovering 100% of a subrogation claim paid to the owner of heavy equipment from the purchaser of the vehicle which had been previously stolen. The Court held that the subrogation claim was not barred because contact had been made by the purchaser to verify the title with the insured prior to the purchase from the thief. We were able to convince the Court that such conduct did not make the defendant a bonafide purchaser.
