The United States District Court interpreted environmental law and specifically CERCLA, the New Jersey Spill Compensation Control Act, where potentially responsible parties (PRP’S) agreed to remediate a contaminated site. These PRPs brought a contribution action against the present owners of the site, who filed a motion for summary judgment. The court determined that there were fact issues outstanding as to the liability of each potentially responsible party and that the state oversight costs were recoverable, but not federal costs.
