Merenoff v. Merenoff, 76 N.J. 535, 388 A.2d 951 (1978)

Practice Areas: General Liability

Appeals were taken from decisions of the Superior Court, Appellate Division, affirming the dismissal of two tort actions between spouses on grounds of interspousal immunity. The Supreme Court, Handler, J., held that although there are situations where, as a matter of law or fact, claims for personal injuries between married persons will not justify a recovery, interspousal tort immunity does not exist to bar a civil suit between married persons for damages for personal injuries.
