Ryan v. Township Of Mount Olive, — N.J. Super. – (App Div. 2010)

Practice Areas: Employment Law

Former Assistant to the Mayor claimed that she was subjected discrimination due to her age, gender, political affiliation and in retaliation for her prior workers’ compensation claim. The Superior Court, Law Division, Morris County, entered summary judgment in favor of defendants. Plaintiff appealed. The Superior Court, Appellate Division, held that plaintiff failed to establish prima facie showings of sexual harassment, age discrimination, gender discrimination, retaliation for having taken FMLA leave and retaliation for previously filing a workers’ compensation claim. Additionally, the Appellate Division dismissed plaintiff’s political affiliation discrimination claim since it was not raised at the trial court level.
