An action on behalf of an infant plaintiff based upon lead poisoning in the home of our client. During the course of discovery our office obtained a dismissal of the plaintiff’s complaint with prejudice for failure to answer interrogatories. The plaintiff appealed, seeking to have the case restored to active trial status. The Appellate Division accepted our argument and affirmed.
