11 year old girl injured in the locker room of a Curves for Women health club operated by client when the bench she was sitting on to change her sneakers fell over. Judge Pagones, Supreme Court, Dutchess County denied our Motion for Summary Judgment on the grounds that there was an issue of fact as to whether or not there was defective condition in the bench which caused or contributed to this accident.
