Mascola v. Mascola, 168 N.J.Super. 122, 401 A.2d 1114 (App. Div. 1979)

Practice Areas: General Liability

Child, who had been bitten by dog which uncle had left with child’s parents for safe keeping, sued parents. The Superior Court, Law Division, granted partial summary judgment for plaintiff as to liability on count asserting strict liability under “dog bite” statute, and defendants appealed. The Superior Court, Appellate Division, held that “owner” within statute imposing strict liability for dog bite on owner of dog does not include temporary keepers of dogs.
