Mecca v. Suarez, — N.J. Super. – (App Div. 2011)
Practice Areas: Intellectual Property, Copyright and Trademark, and Personal Injury Litigation
Following an adverse jury verdict in plaintiff’s malicious prosecution action, the Superior Court, Appellate Division, affirmed the trial court’s evidentiary rulings related to the admission of testimony and other references to unrelated defamation actions involving the parties. The Appellate Division applied the four-part Cofield analysis in regard to the admissibility of “other wrongs evidence” and reiterated the standard of deference owed to a trial court’s evidentiary rulings in affirming the court below. As such, the verdict we obtained on behalf of our client was affirmed.
