Savino v. Paterson Housing Authority, 260 N.J.Super. 316, 616 A.2d 930 (App. Div. 1992)

Practice Areas: General Liability

Our firm represented the defendant in this action brought to recover damages for injuries a police officer received when he slipped and fell down a housing project stairway while responding to an emergency call for assistance. The Appellate Court’s ruling was affirmed to hold that the Fireman’s Rule barred the officer’s personal injury action because the defendant did not act with reckless indifference to the consequences. The Court agreed with our argument that the Housing Authority had made a continuous effort to do its best in the face of an overwhelming situation, and therefore could not be guilty of wanton misconduct.
