Article: Eatroff/Harrison Article on post-AICRA auto “step downs”
It has taken a while, but at long last a trial judge in a published opinion has acknowledged the availability of so-called “basic” policies as lowering the statutory minimum auto insurance required in New Jersey. If the Mannion decision is followed by other trial judges then the voidance ab initio of a liability policy will require even innocent third parties to look elsewhere for bodily injury, and perhaps even PIP coverage.
This decision could have even greater impact on the industry now that more and more carriers are accepting applications and claim reports online.
