Andrew J. Gibbs

Partner

Mr. Gibbs joins M&W with over 28 years of experience handling complex commercial, casualty and insurance litigation and coverage matters for clients in the business and insurance sectors. He evaluates insurance coverage questions and litigates insurance coverage disputes in state and federal court on behalf of general liability, property, homeowners, cyber, Jewelers Block, and other specialty line insurers. He also handles complex, high-exposure defense litigation in cases involving premises liability, general liability, automobile negligence, professional liability, commercial and construction defect claims. Mr. Gibbs uses his extensive experience to provide clients and insurance companies with business-savvy risk assessment, allocation, and management advice.

He helped a major car rental company prevail in the Supreme Court of New Jersey in Robinson v. Coia, 183 N.J. 25 (2005), a decision which reversed the Appellate Division and held that: 1) a rental car company may self-insure to fulfill the liability requirements of N.J.S.A. 45:21-3; 2) a rental car company’s policy or self-insurance is not required to be primary in respect of a renter’s liability to third parties; and 3) the coverage provided by a rental car company and renter’s personal insurance should be co-primary where they are considered to be “excess” to each other.

Mr. Gibbs previously worked as a partner at several mid-sized law firms and a Philadelphia-based AM Law 100 firm. Prior to entering private practice, he clerked for the Hon. Edward W. Beglin, Jr., A.J.S.C. in the Superior Court of New Jersey, Union County.

Mr. Gibbs will continue to handle coverage and defense matters at M&W.
